1. Agreement to Terms & Contractual Scope

These Terms and Conditions constitute a legally binding agreement between you (whether individually or on behalf of an entity) and GenerateCustomQR Media & Software Technologies ('GenerateCustomQR', 'we', 'us', or 'our', accessible via generatecustomqr.com) governing your access to and use of the GenerateCustomQR web application, vector rendering tools, and related services.

By accessing our website, creating QR codes, or downloading generated graphics, you expressly acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of the service.

2. Commercial License & Ownership of Outputs

We believe in empowering creators, agencies, and businesses without legal friction. We grant you broad, unrestricted commercial rights over the assets you generate:

• Perpetual Commercial & Personal License: All QR code graphics (including PNG raster files, SVG vector paths, and PDF print files) generated using our service are 100% royalty-free for both personal and commercial use worldwide in perpetuity.
• Ownership of Generated Output: You retain all intellectual property rights and ownership over the customized image files you create. GenerateCustomQR claims no copyright or proprietary interest in your generated barcodes.
• No Royalties or Recurring Fees: You may print, publish, distribute, broadcast, broadcast on television, or incorporate your generated QR codes into commercial products without paying licensing fees or recurring royalties.
• No Attribution Requirement: You are not required to display watermarks, logos, or attribution linking back to GenerateCustomQR on your physical print materials, packaging, or digital media (though word-of-mouth recommendations are always appreciated).

3. Platform Intellectual Property Rights

While you own the specific output files you generate, GenerateCustomQR retains exclusive ownership of the underlying software platform:

• Platform Software & Codebase: The source code, algorithmic matrix math, web styling, user interface design, logos, and custom SVG frame geometries remain the exclusive intellectual property of GenerateCustomQR.
• Prohibition Against Platform Cloning: You may not copy, reverse-engineer, decompile, or redistribute the web application interface to operate a competing commercial clone using our proprietary branding or assets.

4. Acceptable Use Policy & Prohibited Conduct

To safeguard internet security and prevent fraudulent misuse of QR barcodes, you agree not to use GenerateCustomQR for unlawful or harmful purposes. You may NOT generate QR codes that encode:

• Malicious URLs & Phishing Portals: Links designed to deceive users into revealing banking credentials, passwords, or personal identity, or links that initiate drive-by malware, ransomware, or spyware downloads ('Quishing').
• Fraudulent & Scam Content: Destinations facilitating cryptocurrency scams, deceptive lottery schemes, pyramid fraud, or unlawful financial solicitations.
• Illegal Contraband & Defamatory Material: Content that promotes illegal substances, hate speech, terrorism, harassment, child sexual exploitation, or copyright infringement.
• Automated Platform Abuse: Launching automated scrapers, denial-of-service (DDoS) flood attacks, or excessive rapid requests intended to overload or degrade our hosting infrastructure.

5. Nature of Static QR Codes & Lifespan Guarantee

Understanding the technical nature of static QR codes is vital to ensuring successful deployment:

• Direct Matrix Encoding (Static): GenerateCustomQR generates authentic static QR codes conforming to ISO/IEC 18004. Your payload (URL, text, Wi-Fi password) is directly mathematically encoded into the 2D black-and-white module pattern.
• No Dependency on Our Servers: Because the data resides directly inside the image pixels, scanning a generated code communicates directly between the scanning smartphone and your destination server. The code never routes through our servers and will continue scanning forever even if GenerateCustomQR is temporarily offline.
• No Remote Modifiability: Because static QR codes contain the raw destination payload, they cannot be edited after printing. If you print a QR code and later change your website URL or Wi-Fi password, you must generate and print a new code. We strongly urge checking all URLs before printing.

6. Pre-Press Print Standards & Scannability Guidelines

QR code scannability is fundamentally determined by physical optics, contrast ratios, and environmental lighting. Users are strictly required to adhere to the following pre-press production standards:

• Minimum Contrast Ratio (≥ 4.5:1): Always maintain high contrast between the dark foreground modules and the light background. Avoid low-contrast pairings (e.g., light gray on white, or dark purple on black).
• Quiet Zone Preservation (4 Modules): Maintain a clean, uninterrupted quiet border of at least 4 modules (or 2 modules for Micro QR) around all four sides of the matrix. Do not bleed background artwork into the quiet zone.
• Scanning Distance Formula (10:1 Ratio): As a general rule, the physical width of the QR code should be at least 1/10th of the expected scanning distance. For a handheld brochure scanned from 20cm away, the QR code must be at least 2cm x 2cm. For a billboard scanned from 10 meters away, the QR code must be at least 1 meter wide.
• Center Logo Sizing Constraints: When embedding a brand logo, ensure it does not cover more than 25% to 30% of the total matrix area. Always select Error Correction Level 'H' (High - 30% recovery) or Level 'Q' (Quartile - 25% recovery) to compensate for the obscured modules.
• Export Formats & Vector Architecture: Standard unstyled QR codes export as mathematical vector XML (<path>). Customized QR codes (featuring custom dot geometries, gradients, drop shadows, CTA frames, or embedded brand logos) package high-resolution 300 DPI graphics within the SVG and PDF containers for maximum visual fidelity, antialiased edge smoothing, and reliable smartphone optical decoding.
• Mandatory Physical Proof Testing: You bear sole responsibility for conducting physical test-scans of hardcopy printed proofs across multiple smartphone models (iOS Camera, Android Google Lens, Samsung Camera, and budget optical sensors) in real-world lighting conditions prior to committing to mass commercial print runs.

GenerateCustomQR is provided on an 'as-is' and 'as-available' basis without warranties of any kind:

• No Implied Warranties: To the maximum extent permitted by applicable law, we expressly disclaim all warranties, whether express, statutory, or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• No Optical Hardware Guarantee: While our QR matrix generation strictly complies with ISO/IEC 18004 standards, we do not warrant that all third-party camera hardware, damaged smartphone lenses, low-resolution optical sensors, or non-standard scanner apps will decode every custom design.
• Uptime & Uninterrupted Access: We do not guarantee that the web service will be 100% uninterrupted, error-free, or free of temporary server maintenance downtimes.

9. Limitation of Liability

To the fullest extent permitted by law, GenerateCustomQR, its creators, contributors, hosting infrastructure providers, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, lost profits, lost revenue, commercial printing costs, wasted manufacturing expenses, advertising spend, loss of data, or business interruption arising out of your use of or inability to use the service, even if advised of the possibility of such damages.

10. Indemnification Obligations

You agree to defend, indemnify, and hold harmless GenerateCustomQR and its operators from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms, the content or destination URLs encoded into your QR codes, or your infringement of any third-party intellectual property or privacy rights.

GenerateCustomQR does not host, control, inspect, or endorse third-party web destinations linked through generated QR codes. We disclaim all responsibility for the availability, security, accuracy, or legality of any external websites or services linked via barcodes created by our users.

12. Service & Terms Modifications

We reserve the right to modify, enhance, update, or discontinue features of GenerateCustomQR at any time to improve performance, user experience, and security. We may also revise these Terms periodically. Continued use of the platform following the publication of revised terms constitutes your acceptance of the updated Terms.

13. Governing Law, Severability & Contact

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. In the event of a merger, acquisition, or sale of company assets, these terms and intellectual property rights may be assigned to the acquiring entity.
